Abstract
Apartheid in the criminal justice system examines the racial and social discrimination that leads to inequality in access to justice. This phenomenon particularly affects groups in countries with specific historical contexts, subjecting them to humiliation and inequality due to their racial or ethnic characteristics. This research analyzes the history of apartheid and its impacts on judicial processes, investigating the legal and racial injustices that result in the abuse of power. This study also addresses the social and cultural impact of apartheid on public trust in the justice system. Through analytical methods, patterns of apartheid in criminal proceedings and the disregard for human rights are identified. The findings include recommendations for reforming the system and promoting social justice. The objectives of this research include raising public awareness, determining strategies to combat discrimination, and examining the role of international institutions in supporting human rights within criminal systems. Apartheid manifests itself in various forms within the judicial system, including discrimination in law enforcement and inequality in access to legal counsel. This research also explores the experiences of different countries in addressing this phenomenon and emphasizes the necessity for changes in judicial systems to rectify inequalities. The ultimate goal is to promote social justice and human rights for all members of society.
