The condition of a criminal who, due to his mental disorder, his freedom disturbs security and public order, and is very likely to commit a crime, is called insane with a dangerous state. Detention of criminals with a dangerous state caused by insanity is provided for in Article 150 of the Islamic Penal Code. Regardless of the ambiguities and challenges in the discussion of the diagnosis of the dangerous state caused by insanity, the lack of provision of a suitable place of detention for the detention of insane criminals is an important issue in the management of the detention of dangerous criminals. Appropriate security measures for a person with a dangerous condition and the lack of provision and provision of a suitable place for the detention of insane criminals are among the significant topics and the review of this article. Conducting this research is an attempt to identify the dangerous state caused by insanity as well as analyze and investigate the detention of insane criminals with a dangerous state in Iran's criminal law with a view to other penal systems. The research method is based on document study with descriptive analytical approach. The results of this article indicate that in Iran's criminal system, there is no specific rule and criteria for detecting the dangerous state caused by insanity. Also, due to the lack of provision of a protected forensic psychiatric hospital in Iran for the treatment and maintenance of criminals with a dangerous condition, the issue of removing the dangerous condition of this category of criminals is ambiguous.
