The question of the present article is, what was the theoretical starting point of the difference in the sanctions diplomacy of the Trump and Obama administrations towards Iran from the perspective of international humanitarian law despite the country's commitment to the JCPOA obligations? The hypothesis of the article is that while the sanctions policy of the Obama administration was mostly based on the motive of making Iran commit to international norms, the main motive of the Trump administration is to advance the maximum interests of the United States regardless of international legal restrictions. From this point of view, the JCPOA has been considered an efficient agreement for the Obama administration and ineffective for the Trump administration. The hypothesis theoretically relies on two theories of realism and liberalism about the function of sanctions in international relations. This hypothesis will be analyzed in an analytical-explanatory manner and based on reliable data.}, keywords = {Iran,International humanitarian law,Nuclear Negotiations,America,sanctions}, title_fa = {کالبد شناسی تعهدات برجام بین ایران و آمریکا درمورد مذاکره هسته ای از منظر حقوق بین الملل بشردوستانه}, abstract_fa = {بد عهدی ‌های ناشی از عدم حسن نیت طرف ‌های غربی و به ویژه آمریکا در ماه های پس از اجرایی شدن برجام و به شکل ملموس ‌تر پس از آغاز ریاست جمهوری ترامپ، در تعارض با حسن نیت در اجرای تعهدات بین ‌المللی برجام بوده و با توجه به تأکید قطعنامه 2231 شورای امنیت بر ضرورت اجرای کامل برجام و خودداری از هر گونه اقدام تضعیف کننده این سند همکاری، اظهارات رئیس جمهور آمریکا و برخی اقدامات انجام شده توسط تیم وی و کنگره این کشور در خصوص برجام، همان گونه که اتحادیه اروپا و کشورهای اروپایی و روسیه نیز بر آن اذعان دارند، تضعیف کننده این سند و مغایر با روح برجام و قطعنامه الزام‌آور 2231 محسوب می‌گردد. سؤال مقاله حاضر این است که نقطه عزیمت نظری تفاوت در دیپلماسی تحریمی دو دولت ترامپ و اوباما در قبال ایران از منظر حقوق بین الملل بشر دوستانه با وجود تعهد این کشور به تعهدات برجام چه بوده است؟ فرضیه مقاله این است که در حالی که سیاست تحریمی دولت اوباما بیشتر مبتنی بر انگیزه متعهد سازی ایران به هنجارهای بین‌المللی بود، انگیزه اصلی دولت ترامپ پیشبرد حداکثری منافع آمریکا فارغ از محدودیت‌ های حقوقی بین ‌المللی است. از این منظر، برجام برای دولت اوباما، توافقی کارآمد و برای دولت ترامپ، نا کارآمد تلقی شده است. فرضیه به لحاظ نظری بر دو نظریه واقع ‏گرایی و لیبرالیسم درباره کارکرد تحریم در روابط بین‌الملل متکی است. این فرضیه به نحو تحلیلی- تبیینی و با تکیه بر داده‌ های معتبر بررسی خواهد شد.}, keywords_fa = {ایران,حقوق بین ‌الملل بشر دوستانه,مذاکرات هسته ‌ای,آمریکا,تحریم}, url = {https://www.jhvmn.ir/article_253204.html}, eprint = {https://www.jhvmn.ir/article_253204_ad36f16d3bab03edf40e08d05a9d8d7c.pdf} }
